1. Our Commitment to Privacy

   Jackpot Rewards, Inc., and its subsidiaries and affiliated entities (collectively, "Jackpot Rewards", "we", or "us"), are committed to respecting and protecting your privacy. This Privacy Policy ("Privacy Policy") discloses the information we gather on www.jackpotrewards.com (the "Site"), as well as ways in which we process and, share such information and how you can correct or change such information. Except where otherwise expressly indicated herein or on the Site, this Privacy Policy applies only to information collected on the Site and does not apply to information collected outside of the Site.

   This Privacy Policy addresses our privacy practices relating to the general use of our Site by visitors, as well as anyone who becomes a Member of Jackpot Rewards ("Member"). Visitors to the Site and Members shall be referred to collectively as "Users" in this Privacy Policy Before submitting information to the Site, please read this Privacy Policy. By visiting the Site, submitting information or using any of our products or services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and consent to having your data transferred to and processed in the United States. If you do not agree to this Privacy Policy, please do not use the Site.

2. The Information We Collect

   This Site is intended to provide a unique, educational, and entertaining experience for users without requiring them to submit any more Personally Identifiable Information ("PII") than is necessary to participate in particular activities that may be offered, or to use the Site effectively. We do not require users to register or submit PII in order to visit the Site. Some activities on the Site can be performed without providing PII. When we ask for PII to participate in an activity we will not require anyone to disclose more PII than we believe is reasonably necessary to participate in the activity. We collect the following categories of information from our Users:

   1. Personally Identifiable Information ("PII")

      We may receive and store any information you enter on the Site or provide to us in any other way through or via the Site that would allow us to identify you personally or contact you (collectively "Personally Identifiable Information" or "PII"). The PII you provide to us only will be used by Jackpot Rewards in accordance with this Privacy Policy. Examplesof PII we may collect from you:

      • your name, address, phone number(s) (wireline and/or mobile), e-mail address, or screen name;

      • credit card information including security code and expiration date;

      • information provided by winners of sweepstakes and contests for a necessary background check or for tax purposes;

      • PII you provide about yourself when you send us an e-mail.

      • You can choose not to provide us with certain PII, but then you may not be able to become a Member or use certain Jackpot Rewards services or products

   2. Co-branded Micro Sites

      You may register with Jackpot Rewards on Web pages and/or micro websites that are co-branded with Jackpot Rewards and third-party names, logos, and/or properties ("Micro Sites"). These Micro Sites are operated and maintained by third parties. If you complete a registration for Jackpot Rewards on one of these Micro Sites you will be asked to agree to the Jackpot Rewards Privacy Policy, as well as the Privacy Policy, if any, of the third party who maintains the Micro Site. While Jackpot Rewards will handle the information you provide in accordance with this Privacy Policy, we are not responsible for the content, practices, or information practices (including but not limited to information practices relative to the gathering and use of PII) of the Micro Sites operated by these third parties. In addition, the Jackpot Rewards co-branding of any Micro Site does not constitute sponsorship, endorsement, or approval by us of the content, policies, practices, or products of these Micro Sites. All users should check the relevant website's privacy policy and terms of use in order to understand their policies and practices regarding the collection and use of PII.

   3. Passive Gathering of Information Electronically

      1. Cookies

         During the course of any visit to the Site, the pages you see, along with something called a "cookie," are downloaded to your computer. Cookies are small pieces of information that are stored by your browser on your computer's hard drive. These cookies do not contain or collect any PII, but they do enable us to provide features such as personalization. Most web browsers automatically accept cookies, but you can usually change your browser to limit or prevent cookies. Cookies in themselves do not identify the individual user, but rather the computer used. Users may have the opportunity to set their computers to accept all cookies, to notify them when a cookie is issued, or to not receive cookies at any time. Different browsers may address cookies differently. If you set the browser to not accept cookies, it may result in certain personalized services not being provided to users of that computer.

      2. Beacons

         A web beacon is a transparent image file. Web beacons enable us to track website usage information, such as the number of times a given web page has been viewed. Web beacons are invisible to you and (unlike cookies) are not placed on your computer. They may be used in association with cookies to understand how visitors interact with the pages and content on the pages of the Site.

         Web beacons may also be used to track whether you have opened an HTML email. When the email is opened a part of the code that makes up the HTML page calls a web server to load the web beacon which then generates a record showing that the email has been viewed. Web Beacons may also recognize when the email was opened, how many times it was forwarded and which URL's (links within the email) were clicked.

         We do NOT use web beacons to collect or otherwise record any type of PII provided by or about any User.

   4. E-mail Communications

      When you send an e-mail to Jackpot Rewards, either through the Contact Us or Member Services areas of the Site or otherwise, Jackpot Rewards may retain your e-mail address and the contents of the e-mail you send.

   5. Non Personally Identifiable Information

      From time to time, we may also ask you to provide us with non-PII which is data that does not allow us to identify you, such as your first name, zip code, age, gender, product and promotional preferences, and household characteristics like presence of children or income bracket. Your non-PII may be aggregated and used for our internal purposes or for creating reports for third-party advertisers and partners, or otherwise shared with third parties for any lawful purpose, without your permission. No third party will know who you are as a result of the use of your non-PII.

      We also we may automatically collect Site usage information, such as the numbers and frequency of Users to the Site, pages visit and similar data. This data is used in the aggregate, that is, as a statistical measure, and not in a manner that would identify you personally. Aggregate information generally is collected through the use of cookies and web beacons as discussed above.

3. How We Use Information

   When you provide us with your PII, we may use such information for a number of purposes, including:

   1. To register you for the Jackpot Rewards membership program, sweepstakes, contests, surveys or promotional activity;

   2. To manage Member accounts;

   3. To notify you if you are a winner in a sweepstakes or contest and for coupon, premium, prize delivery;

   4. To facilitate communication between Jackpot Rewards and Users including, without limitation, responding to Users questions or comments, sending e-mails concerning Jackpot results, "Deal of the Day" and other promotions, or to contact you for feedback regarding us, advertisers or business partners;

   5. To provide a report to our advertisers or business partners that tells them who responded to a particular offer or to facilitate the fulfillment of an order that you have made with an advertiser or business partner;

   6. To provide Users with important functionality changes to the Site, new Jackpot Rewards services and special offers from Jackpot Rewards and reputable third parties that we think you will find valuable;

   7. To customize, analyze, adjust and improve the Site to meet our Users', advertisers' or business partners' needs and expectations; or

   8. To enforce our agreements with you, prevent fraud and other prohibited or illegal activities, for other legally permissible purposes and generally to ensure that we comply with applicable laws; or .

   9. To contact via telephone: By registering at the Site or otherwise signing up for Jackpot Rewards, including without limitation free trial offers available on other websites, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR §310 et seq.) (the "Rule"), as amended from time to time. This means that even if your telephone number is listed on the Federal Trade Commission's Do-Not-Call List or Jackpot Reward's Do-Not-Call List, we reserve the right to contact you via telemarketing in accordance with the Rule.

4. Disclosure of Information To Third Parties

   Jackpot Rewards may give, share, sell or trade your PII to or with any third parties under the following circumstances:

   1. Fulfillment of Services

      We may retain other companies and individuals to perform certain functions on our behalf. Examples include companies that help to administer the Jackpot Rewards membership program, sweepstakes, contests, surveys or promotional activities, shipping companies that deliver a prize or premium, third party advertisers or promotional partners who provide a product or service to you, customer support specialists, web hosting and internet service companies, data analysis firms and sweepstakes administrators. Such third parties may be provided with access to PII needed to perform their functions but may not use such information for any other purpose.

   2. Disclosure to Third Party Advertisers and Promotional Partners for Promotion Offers

      From time to time, Jackpot Rewards may share your Personally Identifiable Information with third party advertisers or promotional partners so that those third parties may provide you with an offer or promotion that we believe you will find valuable.

      Users who do not want to receive this information may tell us as described in section V below "Option to Limit Sharing with Third Parties." Any of your PII that is shared with our third party advertisers or promotional partners is subject to their privacy policies and Jackpot Rewards does not have any control over or responsibility for the privacy practices of these third parties. If you have questions about how these companies use your PII, we encourage you to review and understand their respective privacy policies.

   3. Compliance with Law and Fraud Protection

      We may disclose any information, including, without limitation, PII, that we deem necessary, in our sole discretion and without your prior permission, to comply with any applicable law, regulation, legal process or governmental request. We may also exchange information, including, without limitation, PII, with other companies and organizations for credit fraud protection, risk reduction and related activities or to protect the rights, property of safety of Jackpot Rewards, its agents, employees or affiliates or others. Jackpot Rewards reserves the right to disclose PII for a User who we believe is in violation of our Membership Terms, Website Terms of Service, Privacy Policy or Sweepstakes Official Rules, even without a subpoena, warrant, court order or other governmental request.

   4. Sale or Transfer of Information

      In the event of a sale, merger, liquidation, dissolution or sale or transfer of substantially all of the assets of Jackpot Rewards or the Site, PII and/or other information collected about you from the Site may be sold, assigned or transferred to the party acquiring all or substantially all of the equity and/or assets of Jackpot Rewards or the Site in order to permit the party to continue the operation of Jackpot Rewards and/or the Site or any successor version of the Site. You consent to the sale and transfer of your information as described in this paragraph.

5. Option to Limit Sharing with Third Parties for Promotional Purposes

   Jackpot Rewards may give, share, sell, or trade your PII to or with third parties for the purpose of marketing through direct mail, emails, or telephone calls. If you do not wish to have your PII shared with third parties for this purpose, you have several options to limit such sharing. First, you may opt-out when you complete your registration with the Site by editing your "My Account Preferences" on your "My Account" page. Second, if you wish to change your choices in the future, you may, at any time, either: edit your "My Account Preferences" on your "My Account" page on the Site or send us an email at memberservices@jackpotrewards.com with the subject line "Limit Sharing with Third Parties". For those Users who do not have access to a "My Account" page, you may mail your request to Jackpot Rewards, Inc. Member Service, 275 Grove Street, Suite 3-120, Newton, MA 02466 or send an e-mail to memberservices@jackpotrewards.com. We will process your request as soon as reasonably practicable. If you choose to opt-out of further direct marketing, we will keep your e-mail address, phone number, name and physical address on file for the purpose of honoring your request. In addition, you may unsubscribe from specific marketing emails from either us or third parties by following the instructions on how to "unsubscribe" in those e-mails. Please keep in mind that any changes that you make to your email preferences may take up to ten (10) business days to process and the sender of the e-mail has the obligation to honor a request to unsubscribe. Jackpot Rewards is not responsible for any third parties' failure to honor a opt-out request. Please also note that we may continue to contact you to provide service to your account as long as you are a Jackpot Rewards Member.

6. Important Disclosures, Practices and Contact Information

   1. Your Account Information

      When you register to become a Member of the Site, the information you provide to Jackpot Rewards will be stored in a profile on your "My Account" page. The profile, or a portion thereof, may be viewed by us and anyone else to whom you provide the e-mail and password associated with your account or anyone who has access to your computer when you are logged on to the Site. You are responsible for maintaining the confidentiality of your e-mail and password. You are entirely responsible for any and all activities which occur under your account whether or not authorized by you. You agree to immediately notify Jackpot Rewards of any unauthorized use of your account.

   2. Third Party Links and Third Party Advertisements

      The Site contains links to third-party web sites. Please be aware that we cannot control and are not responsible for the information collection practices of such web sites, which may differ from those of Jackpot Rewards. We encourage you to review and understand the privacy policies of these web sites before providing any information to them.

      We may include banner, icon or text advertisements for third parties (or for sites operated by third parties) that are not sponsors of and are not affiliated with Jackpot Rewards or the Site. Should you click on any such advertisement, you will leave our Site and be taken to the advertiser's website. We are not responsible for the content, practices, or information practices (including but not limited to information practices relative to the gathering and use of PII) of the websites operated by these third parties. In addition, these advertisements do not constitute sponsorship, endorsement, or approval by us of the content, policies, practices, or products of these websites. All Users should check the relevant website's privacy policy and terms of use in order to understand their policies and practices regarding the collection and use of your information, including PII.

   3. Data Security

      We maintain a variety of commercially reasonable physical, electronic and procedural safeguards designed to protect your PII from unauthorized access and disclosure. For example, we use industry accepted tools and techniques to protect against unauthorized access to our systems. You should be aware, however, that Jackpot Rewards has no control over the security of other web sites on the Internet that you might visit even when a link may appear to those web sites site from our Site. If you share your computer or use a computer that is accessed by the general public, remember to sign off and close your browser window when you have finished your session. This will help to ensure that others cannot access your PII.

      We want you to feel confident using the Site. However, no system can be completely secure. Therefore, although we take commercially reasonable steps to secure your information, we do not promise, and you should not expect, that your PII, searches or other communications always will remain secure. In the event of a breach of the confidentiality or security of your PII, we will notify you if reasonably possible and as reasonably necessary so that you can take appropriate protective steps. We may notify you under such circumstances using the e-mail address(es) we have on record for you. Users should also take care with how they handle and disclose their PII. Please refer to the Federal Trade Commission's Web site at http://www.ftc.gov/bcp/menus/consumer/data.shtm for information about how to protect yourself against identity theft.

   4. Children

      The Site is restricted to Users and not intended for persons under the age of 18. Jackpot Rewards does not knowingly market to, or solicit information, accept service or collect information from any person under the age of 18. If we become aware that any person submitting a registration or information to a Site is under the age of 18, we will attempt to delete the account and any related information as soon as possible. We require that only persons 18 years of age or older use the Site. By using the Site, you hereby represent that you are at least 18 years old.

   5. Accessing, Updating or Deleting Your Personally Identifiable Information

      Jackpot Rewards respects the privacy of your PII. If you are a Member and would like to review, update or delete your profile, please log in to your account and select "My Account" where you can review, modify or delete your membership. If you are not a Member but have provided PII to us and wish to delete such information, you may reach us via the Contact Us page on the Site.

   6. Changes to this Privacy Policy

      We may occasionally update this Privacy Policy to reflect changes in our practices. When we post changes to this Privacy Policy, we will revise the updated date at the top of this Privacy Policy. If we make any material changes to our Privacy Policy, we only will notify Members by sending an e-mail to the e-mail address(s) provided to us in the Member's account, profile or registration, and by prominently posting notice of the changes on the Site. We will give you an opportunity to opt-out of any materially changed Privacy Policy or alternatively, cancel your membership. We recommend that you check the Site from time to time to inform yourself of any changes in this Privacy Policy or any of our other policies.

   8. California Privacy Rights Under California Civil Code Section 1798.83

      If you are a resident of California ("California Users"), in addition to the rights set forth in this Privacy Policy, you generally have the right to request information from us regarding the manner in which we share certain categories of PII with third parties for their direct marketing purposes. However, under the law, a business is not required to provide this information if it adopts and discloses to the public in its privacy policy a policy of not disclosing customer's personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying California Users of their rights to prevent disclosure of PII and providing a cost free means to exercise that right. As stated above, we do not share such PII with third parties for their direct marketing purposes unless you have requested us to do so, or have otherwise consented, and then subject to your right to opt-out of sharing your PII for third party marketing purposes.

      Please note that whenever you choose to receive future communications from a third party, your information will be subject to the third party's privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as we have no control over how third parties use information. You always should review the privacy policy of any party that collects your information to determine how that entity will handle your information. California Users may request further information about our compliance with this law by sending us a message via the Contact Us link on the Site. Please note that we are only required to respond to one request per customer each year concerning this law, and we are not required to respond to requests made by means other than through the Contact Us link on the Site.

   9. From Outside the United States

      The Site is hosted in the United States and is governed by United States law. If you are visiting any Site from outside the United States, please be aware that your information may be transferred to, stored and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using the Site, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in this Privacy Policy.

   10. No Rights of Third Parties

       This Privacy Policy does not create rights enforceable by third parties.
