Except where otherwise expressly indicated herein or on the Jackpot Rewards website, this Privacy Policy applies only to information collected by Jackpot Rewards and does not apply to information collected outside of Jackpot Rewards. This Privacy Policy addresses JPR's privacy practices relating to the general use of Jackpot Rewards by visitors, as well as anyone who becomes a Member of Jackpot Rewards (“Member”). Visitors to Jackpot Rewards and Members shall be referred to collectively as “Users” in this Privacy Policy. Before using Jackpot Rewards, please read this Privacy Policy. By visiting Jackpot Rewards, submitting information, or using any of JPR's products or services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and consent to having your data transferred to and processed in the United States. If you do not agree to this Privacy Policy, please do not use Jackpot Rewards. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, DO NOT VISIT THE JACKPOT REWARDS WEBSITE.
Jackpot Rewards is intended to provide a unique educational and entertaining experience for Users without requiring them to submit any more Personally Identifiable Information (as defined below) than is necessary to use Jackpot Rewards effectively or to participate in particular activities that may be offered. JPR does not require Users to register or submit Personally Identifiable Information in order to visit Jackpot Rewards. Some Jackpot Rewards activities can be performed without providing Personally Identifiable Information. When JPR asks for Personally Identifiable Information to participate in an activity JPR will not require anyone to disclose more Personally Identifiable Information than JPR believes is reasonably necessary to participate in the activity. JPR collects the following categories of information from JPR Users:
JPR may receive and store any information you provide Jackpot Rewards, enter on the Jackpot Rewards website or provide to JPR in any other way through or via Jackpot Rewards that would allow JPR to identify you personally or contact you (collectively “Personally Identifiable Information” or “PII”). The PII you provide to JPR only will be used by JPR in accordance with this Privacy Policy. Examples of PII that JPR may collect from you, includes, but is not limited to, the following:
i. your name, address, phone number(s) (wireline and mobile), e-mail address, and screen name;
credit card information including security code and expiration date;
iii. PII that is required from winners of sweepstakes and contests for the necessary background check or for tax purposes; and
iv. PII you provide about yourself when you send JPR an e-mail.
v. You can choose not to provide JPR with certain PII, but then you may not be able to become a Jackpot Rewards Member or use certain Jackpot Rewards services or products.
You may register with Jackpot Rewards on website pages and micro websites that are co-branded with Jackpot Rewards and third-party names, logos, and properties (“Co-branded Websites”). These Co-branded Websites may be operated and maintained by third parties. If you complete a registration for Jackpot Rewards on one of these Co-branded Websites you will be asked to agree to the Jackpot Rewards Privacy Policy, as well as the privacy policy, if any, of the third party who maintains the Co-branded Website. While Jackpot Rewards will handle the information you provide in accordance with this Privacy Policy, JPR is not responsible for the content, practices, or information practices (including but not limited to information practices relative to the gathering and use of PII) of the Co-branded Websites operated by these third parties. In addition, the Jackpot Rewards co-branding of any Co-branded Websites does not constitute sponsorship, endorsement, or approval by JPR of the content, policies, practices, or products of these Co-branded Websites. ALL USERS SHOULD READ THE RELEVANT CO-BRANDED WEBSITE'S PRIVACY POLICY AND TERMS OF USE IN ORDER TO UNDERSTAND THEIR POLICIES AND PRACTICES REGARDING THE COLLECTION AND USE OF PII.
During the course of using Jackpot Rewards, the pages you see, along with something called a “cookie,” are downloaded to your computer. Cookies are small pieces of information that are stored by your browser on your computer's hard drive. These cookies are designed to not contain or collect any PII, but they do enable JPR to provide features such as personalization. Most web browsers automatically accept cookies, but you can usually change your browser to limit or prevent cookies. Cookies in themselves do not identify the individual user, but rather the computer used. Users may have the opportunity to set their computers to accept all cookies, to notify them when a cookie is issued, or to not receive cookies at any time. Different browsers may address cookies differently. If you set the browser to not accept cookies, it may result in certain personalized services not being provided .to users of that computer.
A web beacon is a transparent image file. Web beacons enable JPR to track website usage information, such as the number of times a given web page has been viewed. Web beacons are invisible to you and (unlike cookies) are not placed on your computer. They may be used in association with cookies to understand how visitors interact with the pages and content on the pages of the Jackpot Rewards website. JPR may use web beacons to track usage information and to compile information about how Jackpot Rewards Users shop and use different products and services. Web beacons may also be used to track whether you have opened an HTML email. When the email is opened a part of the code that makes up the HTML page calls a web server to load the web beacon which then generates a record showing that the email has been viewed. Web Beacons may also recognize when the email was opened, how many times it was forwarded and which URL's (links within the email) were clicked.
Jackpot Rewards may enable JPR and third parties working with JPR to collect, log, and analyze information about your online activity as part of its functionality. This is known as “Click Stream Data” which includes, but is not limited to, information such as your IP address, clicks, URLs of web pages that you have viewed, the date that you viewed the web pages, web beacons, and cookie data. JPR and third parties working with JPR may use information collected through Jackpot Rewards to target promotions and other content to you in an effort to create a personally relevant experience, enhance your experience or research, analyze, or enhance Jackpot Rewards.
When you send an e-mail to JPR, either through the Contact Us or Member Services areas of the Jackpot Rewards website or otherwise, JPR may retain your e-mail address and the contents of the e-mail you send.
JPR may also ask you to provide JPR with non-PII which is data that does not allow JPR to identify you, such as your first name, zip code, age, gender, product and promotional preferences, and household characteristics like presence of children or income bracket. Your non-PII may be aggregated and used for JPR's internal purposes or for creating reports for third-party advertisers and partners, or otherwise shared with third parties for any lawful purpose, without your permission. No third party will know who you are as a result of the use of your non-PII.
We also may automatically collect website usage information, such as the numbers and frequency of Users to the Jackpot Rewards website, pages visit and similar data. This data is used in the aggregate, that is, as a statistical measure, and not in a manner that would identify you personally. Aggregate information generally is collected through the use of cookies and web beacons or as Click Stream Data as discussed above.
JPR may use your PII and Non-PII for a number of purposes, including but not limited to the following:
To register you for the Jackpot Rewards membership program, sweepstakes, contests, surveys or promotional activity;
To manage Member accounts;
To notify you if you are a winner in a sweepstakes or contest and for coupon, premium, prize delivery;
To facilitate communication between JPR and Users including, without limitation, responding to Users questions or comments, sending e-mails concerning Jackpot results, Deals of the Day offers, and other promotions, or to contact you for feedback regarding Jackpot Rewards, JPR advertisers or business partners;
To provide a report to JPR advertisers or business partners that tells them who responded to a particular offer or to facilitate the fulfillment of an order that you have made with a JPR advertiser or business partner;
To provide Users with important functionality changes to Jackpot Rewards, new Jackpot Rewards services, and special offers from JPR and reputable third parties that JPR thinks you will find of interest or value;
To research and analyze Users online activity;
To research, analyze, adjust, improve, and customize Jackpot Rewards to better meet the needs and expectations of Jackpot Rewards Users, advertisers, or business partners; and
To enforce JPR's agreements with you, prevent fraud, and other prohibited or illegal activities, for other legally permissible purposes and generally to ensure that JPR comply with applicable laws.
To contact via telephone: By using Jackpot Rewards or by becoming a Jackpot Rewards Member, including without limitation free trial offers available on other websites, you agree that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR §310 et seq.) j. (the “Rule”), as amended from time to time. This means that even if your telephone number is listed on the Federal Trade Commission's Do-Not-Call List or Jackpot Rewards' Do-Not-Call List, JPR reserves the right to contact you via telemarketing in accordance with the Rule.
Any information JPR obtains from you in connection with any mobile service, including SMS services, may include your name, address, mobile phone number, your mobile service provider's name, and the date, time, and content of your messages. In addition to any fee JPR may charge, your mobile service provider's standard messaging rates apply to JPR's confirmation and all subsequent SMS correspondence. All charges are billed by and payable to your mobile service provider. JPR will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an AS IS basis. You may opt out of mobile services via email to Abuse@jackpotrewards.com or by sending “STOP”, “END”, or “QUIT” to the SMS text message you have received. However, such opting out will not apply to any communications from other Jackpot Rewards offerings you have registered for or communications from JPR partners or other third parties to whom JPR may have already provided your information.
JPR may give, share, sell or trade your PII and Non-PII to or with any third parties under the following circumstances:
JPR may retain other companies and individuals to perform certain functions on JPR's behalf. Examples include companies that help to administer the Jackpot Rewards membership program, sweepstakes, contests, surveys, or promotional activities, shipping companies that deliver a prize or premium, third party advertisers, or promotional partners who provide a product or service to you, customer support specialists, web hosting and internet service companies, data analysis firms, and sweepstakes administrators. Such third parties may be provided with access to PII and Non-PII needed to perform their functions but may not use such information for any other purpose.
JPR may share your PII and Non-PII with third party advertisers or promotional partners so that those third parties may provide you with an offer or promotion that JPR believes you will find of interest or value. Users who do not want to receive this information may tell JPR as described in section 6 below “Option to Limit Sharing of PII with Third Parties.” Any of your PII and Non-PII that is shared with JPR third party advertisers or promotional partners is subject to their privacy policies and JPR does not have any control over or responsibility for the privacy practices of these third parties. If you have questions about how these companies use your PII and Non-PII, JPR encourages you to review and understand their respective privacy policies.
JPR may disclose any information, including PII, that JPR deems necessary, in its sole discretion and without your prior permission, to comply with any applicable law, regulation, legal process or governmental request. JPR may also exchange information, including, without limitation, PII, with other companies and organizations for credit fraud protection, risk reduction, and related activities or to protect the rights, property, or safety of JPR, its agents, employees, affiliates or others. JPR reserves the right to disclose PII of a User who JPR believes is in violation of our Membership Terms, the Jackpot Rewards Website Terms of Service, Privacy Policy or Sweepstakes Official Rules, even without a subpoena, warrant, court order or other governmental request.
In the event of a sale, merger, liquidation, dissolution or sale or transfer of all or substantially all of the assets or equity of JPR, Jackpot Rewards or the Jackpot Rewards website, PII, Non-PII, and other information collected about you by JPR may be sold, assigned or transferred to the entity acquiring all or substantially all of the equity or assets of JPR, Jackpot Rewards or the Jackpot Rewards website. You consent to the sale and transfer of your information as described in this paragraph.
JPR may give, share, sell, or trade your PII to or with third parties for the purpose of marketing through direct mail, emails, or telephone calls. If you do not wish to have your PII shared with third parties for this purpose, you have several options to limit such sharing. First, you may opt-out when you complete your registration with Jackpot Rewards by editing your “My Account Preferences” on your “My Account” page. Second, if you wish to change your choices in the future, you may, at any time, either: edit your “My Account Preferences” on your “My Account” page on the Jackpot Rewards website or send us an email at memberservices@jackpotrewards.com with the subject line “Limit Sharing with Third Parties”. In addition, you may unsubscribe from specific marketing emails from either JPR or third parties by following the instructions on how to “unsubscribe” in those e-mails. Please keep in mind that any changes that you make to your email preferences may take up to ten (10) business days to process and the sender of the e-mail has the obligation to honor a request to unsubscribe. If you are a resident of California (“California Users”), in addition to the rights set forth in this Privacy Policy, you generally have the right to request information from JPR regarding the manner in which JPR shares certain categories of PII with third parties for their direct marketing purposes. However, under the law, a business is not required to provide this information if it adopts and discloses to the public in its privacy policy a policy of not disclosing customer's personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying California Users of their rights to prevent disclosure of PII and providing a cost free means to exercise that right. As stated above, JPR does not share such PII with third parties for their direct marketing purposes unless you have requested JPR to do so, or have otherwise consented, and then subject to your right to opt-out of sharing your PII for third party marketing purposes.
Please note that whenever you choose to receive future communications from a third party, your information will be subject to the third party's privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as JPR has no control over how third parties use information. You always should review the privacy policy of any party that collects your information to determine how that entity will handle your information. California Users may request further information about JPR's compliance with this law by sending JPR a message via the Contact Us link on the Jackpot Rewards website. Please note that JPR is only required to respond to one request per customer each year concerning this law, and JPR is not required to respond to requests made by means other than through the Contact Us link on the Jackpot Rewards website.
Jackpot Rewards is hosted in the United States and is governed by United States law. If you are visiting or using Jackpot Rewards from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where JPR's servers are located and JPR's central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country.
